On March 18, 1986, the defendant gained entry into the 23-year-old victim’s apartment by deception and once inside forced her to engage in vaginal intercourse against her will. He threatened to kill her 7-month-old child if she did not comply. Further, he stole $35 in cash and a substantial amount of personal property, such as her stereo and a suitcase. Prior to leaving her apartment, he disconnected her telephone and lef thte scene. The victim then went next door to a doctor’s office and phoned the police.

Ten days later on March 28, 1986, the defendant raped again. His victim was a 52-year-old female. On this date, the victim had just returned to her home after taking her dog for a walk. The defendant had already gained entry into her home. The defendant struck the victim, punching her several times about the face. He then tore off her bra, removed her clothing, and forced her to engage in sexual intercourse with him. He also stole various personal objects fomr her home, including a ring, a knife, and a jacket. A subsequent search of the defendant’s residence revealed property from other burglaries the defendant had committed.

At the time of this offense, the defendant had been released from incarceration for approximately 1 year for prior convictions. These include aggravated burglary under B-762940 in November 1976, and breaking and entering under B-844675 in March 1985.
