Hamilton County Prosecutor Joseph T. Deters announces no charges against homeowner who fired shots when first responders attempted wellness check at his home

Today, Hamilton County Prosecutor Joseph T. Deters announced that no criminal charges will be filed against the homeowner who fired 2 shots at Cincinnati firefighters attempting a wellness check at his Spring Grove Avenue residence in Northside.

First responders were called to the home on Sunday at approximately 9:13 a.m. after friends were unable to reach him and he did not meet them for breakfast as previously scheduled.  When the homeowner did not respond to knocks on his door, first responders attempted to gain access to the home by breaking a window near the door.  The homeowner responded by firing 2 shots.  No one was struck.

Police officers and firefighters were eventually able to speak with the homeowner and he explained that he thought someone was trying to break into his house. 

Prosecutor Deters commented, “No criminal charges are appropriate in this case.   The homeowner thought that someone was trying to break into this home and he fired 2 shots.  No one was injured and the homeowner was completely cooperative with the police and firefighters and explained why he fired the shots.  Everyone is satisfied that this was a misunderstanding.   This man is a Vietnam veteran who served our country and he is also battling a serious illness.   Looking at all of the facts and circumstances of this matter, it would not be appropriate to seek any criminal charges.”
