On June 9, 1991, at approximately 4:30-5:00 p.m., defendant broke into his estranged wife’s apartment by climbing a fire escape and entering through a window. Defendant then confronted his estranged wife in a back bedroom and it is believed that the two began to argue when defendant began to beat his wife with his fist, knocking her to the floor and tearing off her clothes. Defendant then stole a gold necklace and bracelet from the victim’s bedroom and returned to the apartment he shared with his girlfriend. There, defendant cleaned himself and his clothing.

The victim’s children luckily had been over the victim’s sister’s house at the time of this offense. However, the next day, the victim’s 13 year old daughter went to the apartment but found it locked so she climbed the fire escape, entered the home and found her mother’s naked body lying in a pool of blood. The child ran hysterically from the apartment and a neighborhood store owner called police. The victim, Darlene Gilbert, died as a result of blunt trauma to the head and neck area. She had been severely beaten by defendant on the head and torso area and also sustained six broken ribs on the left side of her body. There was also a ligature mark on her neck and a severe laceration behind her right ear.

Further, at the time defendant murdered his wife, he had a domestic violence case pending against him with the same victim in Hamilton County.

Because of the brutal and purposeful acts of this defendant, an innocent woman has been murdered and several children left without their mother. This defendant has a long criminal history and has illustrated his inability to live in a crime-free life or follow court-imposed restrictions.
