Today, Hamilton County Prosecutor Joseph T. Deters announced that no charges would be filed in the January 23rd shooting at the Glenway Pony Keg located at 4931 Glenway Avenue.

Shortly before 5:00 p.m. on January 23rd Cincinnati Police were dispatched to 4931 Glenway Avenue regarding a robbery and shooting. When the police arrived, they located James Douglas deceased at the scene. Douglas was wearing dark clothing and a black ski mask. He had been shot 2 times with injury to his chest and back.

Police investigation, including review of video from the store, revealed that Douglas entered the store brandishing his gun. The only person present in the store was the store owner. Douglas demanded money from the store owner and told her, “give me your money bitch or you gonna die.” The store owner put all of the money from the cash register in a Kroger shopping bag Douglas supplied her and gave the money to Douglas. He also demanded money from the lottery counter. She was then able to retrieve her gun, which she carried pursuant to a valid Concealed Carry Permit, from her person and fire two shots at Douglas. A physical struggle ensued and the store owner ran out of the store. Douglas was behind her and collapsed at the door.

The police located two firearms at the scene. They found a loaded 9 mm Springfield Arms which Douglas brought to the scene and a Ruger .380 semi-automatic owned by the store owner.

They found the Kia Sorento Douglas had driven parked close to the pony keg and left running. The license plates had been removed and placed inside the vehicle.

Based on all of the evidence, the police confirmed that Douglas acted alone.

The store owner sustained minor abrasions and bruising.

Prosecutor Deters commented, “As your prosecutor, I have said this repeatedly. If you go into a store or a home with a gun to rob it, you have forfeited your right to not be shot. ”
