Today, Hamilton County Prosecutor Joseph T. Deters announced the indictment of Robert Fogle for one count of Child Endangering (F2) and one count of Felonious Assault (F2). If convicted, he faces a maximum possible sentence of 8 years in prison.

Two other individuals, Mary Hensley and Kayla Dragston (the child’s mother) were also indicted. Mary Hensley has been indicted for one count of Child Endangering (F3) and one count of Possessing Drug Abuse Instruments (M2). If convicted, she faces a maximum possible sentence of 3 years in prison. Kayla Dragston was indicted with one count of Child Endangering (F3), and one count of Aggravated Possession of Drugs (F3). If convicted, she faces a maximum possible sentence of 6 years in prison.

On March 19, 2021, at the Quality Inn & Suites in Queensgate, Dragston left her 1-year- old child in the care of Fogle and Hensley. Hensley left the room for a period of time, and when she returned, the child was suffering from severe injury.

When police responded to the scene, Fogle barricaded himself inside the hotel room and had to be extracted by the SWAT team.

Hamilton County Prosecutor Joseph T. Deters commented, “I can think of no greater evil in this world than seriously injuring an innocent little kid. I am thankful that law enforcement was able to intervene before something even worse happened. We are praying for the victim in this case, and will do all we can to get justice for her.”
