The facts of the offenses under B-780851 indicate that defendant and his girlfriend Frances Floyd began living with 78 year old Calvin Threets shortly after they helped him free his car from a snow bank in 02/1975. Shortly thereafter, defendant planned to rob Threets. During the course of that robbery the defendant inflicted numerous blows to the torso, neck and head of his victim, 78 yr old Threets. Defendant used his fists and feet, wearing combat boots to administer one of the most severe beatings this office has seen. The victim died as a result of this brutal beating.
In regards to his rape convictions, Brown was part of a gang rape of a fellow inmate while he was being held in the Hamilton County Justice Center. Brown's victim was an 18-year-old youth who had both emotional and mental disabilities. Brown and his accomplices forced the youth to submit to fellatio, anal sex, and masturbation. The youth reported that he submitted after Brown and the others menaced him to the point that he believed that if he "wanted to live more years" he had no choice but to submit.
Brown has shown that he is a violent predator. He has beaten an elderly man to death and he forcibly raped an emotionally and mentally disabled young man.
The defendant is up for early parole due to the recent Hall v. Hageman decision
