The defendant in this matter is a serial rapist. In 1981, Smith and a cohort saw a woman that they decided they wanted to rape. She, however, was with a male friend at the time. So, Smith and his cohort chased the man off by threatening him with a motorcycle chain. After chasing him off, Smith and his partner forced their victim into their car and threatened to use the motorcycle chain against her if she resisted them. They drove her to an apartment complex in Kentucky. She briefly escaped, but they grabbed her and was subsequently raped by Smith and his cohort.
Approximately ten years later, Smith was released from prison for this rape offense. Only months after being released, Smith once again kidnapped and raped another woman. This time he forced himself into the victim?s car and drove to a dead-end street where he orally and vaginally raped her. When the victim refused to tell Smith where she worked he squeezed her mouth so violently that he broke a cap off of one of her teeth.
Beyond these violent rapes, Smith has an extensive criminal history. He has breaking and entering, burglary, receiving stolen property, and various driving offenses. Further, though he attended a Level One Sex Offender treatment program, he was terminated from the program because he cheated on his final exam.
