Hamilton County Prosecutor Melissa Powers announces the Rape Indictment of Michael Toney

Today, Hamilton County Prosecutor Melissa Powers announced the indictment of Michael Toney (DOB 7/6/89) for two counts of Rape (F1), one count of Attempt Rape (F2), two counts of Unlawful Sexual Conduct with a Minor (F3), one count of Gross Sexual Imposition (F3), and one count of Importuning (F3). If convicted, he faces a maximum possible sentence of 36 years in prison.


These incidents occurred between May of 2021 and May of 2023. Toney is accused of sexually assaulting three juvenile males – all of whom are developmentally disabled. Toney would befriend the victims’ adult family members in order to gain access to his victims. Toney would buy gifts for the victims to gain their trust.


In addition to the victims’ disclosures, video evidence was discovered during the course of the investigation.


Hamilton County Prosecutor Melissa Powers commented, “It is absolutely appalling that someone could commit such heinous acts against vulnerable children.


The courage of these victims coming forward not only ensures their safety, but also prevents this individual from doing this to any other child.
